He was wounded and Herrod dragged back to safety saving his life. After North was posted back in the States, Herrod was transferred to another platoon. One night, a patrol in a village suspected of harboring Viet Cong took on machine gun fire which drew return fire from the Marines under Herrod's command. Women and children were killed. Herrod was court-martialed and tried for first degree murder.when Oliver North heard of the charges, he flew back to Vietnam and launched his own investigation which led to Herrod being found innocent.
